In continuation to our ongoing blog series on the key provisions of the Inflation Reduction Act of (IRA), Indegene hosted a webinar in December 2023 where Jack Mycka, William Lobb and Matthew Skoronski highlighted the transformative effects of the Inflation Reduction Act (IRA) on the market access landscape as well as the evolving copay accumulator/maximizer environment.

Key takeaways from the IRA discussion

The IRA addresses drug pricing in a number of provisions including inflation penalties, a cap on Medicare out-of-pocket expenses, and the introduction of negotiated prices for Medicare drugs. Each of these highlight manufacturer’s need for a comprehensive strategy to prepare for implementation of these healthcare reforms.

Manufacturers face significant challenges and opportunities, including the obligation to negotiate under the threat of severe penalties. The political landscape adds complexity, with the potential 2024 presidential election outcome having potential implications on the IRA implementation timeline.

The drugs selected for negotiation highlight the prioritization of patient impact over drug budget impact, as emphasized in the discussion of the initial 10 drugs chosen for negotiation starting in 2025.

Lawsuits filed by manufacturers against the IRA imposed “negotiation mandate”, coupled with uncertainties around potential replacements for drugs like Stelara, contribute to the evolving and dynamic market environment.

The key distinction lies in the approach, with accumulators counting payments as they occur, while maximizers spread the maximum benefit across the year.
